Chu held that she only had to view the evidence in the light most favorable to the prosecution and make a finding of “probable cause” that a crime was committed, The Associated Press reported. To convict Potter on the first-degree manslaughter charge, a jury will have to find that Potter was aware that there was a risk Wright would be killed and “made a conscious decision to act” regardless, Chu wrote.
